Yuhua My SmartHDB Home – 12 months Trial

Terms & Conditions
  1. General
      The use of the Yuhua My SmartHDB Home Trial (“the Trial”) is subject to these terms and conditions (“the Trial Terms and Conditions”).

  1. The Services
      The UM (Utility Management) package offered is valid for Yuhua HDB residents only. The service is valid for one year from the service start date. The UM package require Starhub home broadband to provide the connectivity of the TCAM smart hub to our UM cloud. Please also refer to Starhub Service Term and Conditions for more details.
  1. Eligibility for the Services
    1. Unless otherwise permitted by us in writing, the Services are only available to you if you:-
      1. are a resident having a residential address as stated in your NRIC within the YuHua postal code of zones 2, 3 and 4 (postal codes 600209 to 600240, 601215, 601217, 601219, 601221, 601223 and 601225); and
      2. have an active StarHub Broadband service subscription.
    2. If you are not an existing StarHub Broadband service customer, you must first sign up a StarHub Broadband service before you can sign up for any of the Services.
    3. StarHub retains the sole right and discretion to determine the eligibility of each applicant for the Trial.
  1. Promotion Period
    1. The Services will be made available for subscription between the period from 23 April 2016 to 22 May 2016 (“the Promotional Period”).
    2. StarHub may extend or reduce the Promotional Period as we deem fit, and you will be notified of such changes in accordance with Clause 16 below.
  1. Duration of Services
    1. Upon subscription, each Service shall commence from the Service Start Date, and shall be for duration of twelve (12) months from the Service Start Date.
    2. The Service Start Date will be the date when either TCAM or Silverline confirms to you in writing that all required devices for such respective Service have been successfully installed at your premises. For the avoidance of doubt, the StarHub broadband subscription service will commence on such date as prescribed by StarHub and may commence independently of this Trial or the TCAM or Silverline Services.
    3. In the event of a failure in the installation of the required devices for any Service at your premises for any reason, StarHub reserves the right to decline the provision of such Services to you for the purpose of the Trial, without any liability to you.
  1. Applicable Charges and Payment Terms
    1. You must pay a one-time payment of S$10/- for each Service that you subscribe for. You may subscriber for no more than [1 ] of each Service at each residential address.
    2. Each Service includes a fixed package of the specified services and related devices. If you wish to use additional number of devices which are not within the fixed package, you would have to pay the applicable charges for such additional devices. There will be no refunds provided if you choose not to take up any of the specified services or related devices in a fixed package.
    3. You may make payment either by: (i) credit card at the time you sign up for the relevant Service if you are an existing StarHub Broadband customer; or (ii) cash upon installation of the devices if you are not an existing StarHub Broadband customer.
    4. If you select to pay via credit card, you must do so when you sign-up for the Services at www.starhub.com/smart-hdb-home and in accordance with the conditions set out thereunder through our partner, Telechoice (ePlanet).
    5. If you select to pay by cash upon installation, you will make payment to the technician or other representative of TCAM and/or Silverline respectively, depending on the Services that you have signed up for.
    6. The payment transactions under this Clause 6 shall be made between you and either of TCAM or Silverline. StarHub shall not be responsible or liable to you for any disputes or queries that you may have in relation to the payment transactions for the Trial. For the avoidance of doubt, you will continue to be liable to make payment for the StarHub broadband subscription services in accordance with the applicable StarHub terms and conditions.
  1. Product Warranty
    1. Your unit is warranted against design and manufacturing defects for a period of 12 months from the service start date.
    2. This warranty does not cover the damage to any unit caused by accident, misuse or in anyway being tampered with.
    3. This warranty does not cover the damage resulting from:
      1. Use other than in accordance with the operational instructions
      2. Any alteration or modification to the unit
      3. Practice of any unauthorized repair
    4. As this unit has a limited warranty against design and manufacturing faults during the warranty period, it does not constitute any other form of liability for any loss or damage whatsoever arising from, relating to or in connection with the purchase of the unit.
  1. Liability
    1. The Trial is provided on an "as is" and "as available" basis and you agree that you participate in the Trial at your sole risk. All warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, are fully disclaimed to the fullest extent allowed by law. Except as set out in these Trial Terms and Conditions, we expressly exclude all other liability we may have to you, including all liability in contract, tort, negligence, misrepresentation, strict liability or statute.
    2. Under no circumstances will TCAM be liable for any special, incidental, indirect, consequential or punitive damages, losses, costs or expenses, even if such damages, losses, costs or expenses were caused wilfully, recklessly or negligently.
    3. Under no circumstances will TCAM be liable for any lost profits, revenue, business or anticipated savings, even if such damages, losses, costs or expenses were caused wilfully, recklessly or negligently.
  1. Intellectual Property
    1. You will not acquire any right in any and all intellectual property related to the Trial, and all such property will remain at all times with the respective owners of the intellectual property.
  1. Suspension
    1. All Services will be suspended upon the suspension of your StarHub broadband subscription services with effect from the date of the suspension of the StarHub broadband service, regardless of the reason for the suspension of the StarHub broadband subscription service. Such suspension shall take effect without any further notice to you.
    2. The Services may or may not be restored if the StarHub broadband subscription services are reinstated, and the Services will be restored to such extent and at such times as may be determined by the respective provider of the Service.
  1. Termination of the Services
    1. All Services will terminate upon the termination of your StarHub broadband subscription services with effect from the date of the termination of the StarHub broadband service, regardless of the reason for the termination of the StarHub broadband subscription service. Such termination shall take effect without any further notice to you.
    2. The termination of the TCAM or Silverline Services(s) shall not terminate the StarHub broadband subscription services which may continue independently.
    3. Any of StarHub, TCAM or Silverline (“the terminating party”) may terminate any of the Services immediately by way of written notice to you if you are in material breach of any of the Trial Terms and Conditions or the respective Service Specific Terms and Conditions of the terminating party, and you fail to remedy such breach within 30 days of notice of such breach. Notice of such breach will be deemed service if sent to your residential address by mail, or to the email address that you have provided via email.
    4. StarHub may terminate the Trial immediately by way of written notice to you if the participation of any of StarHub, TCAM or Silverline in the Trial is terminated for any reason.
    5. Upon termination of the Trial or any of the Service provided thereunder, you shall return all devices installed for the purpose of the Trial, to the respective service provider at your own cost.
  1. Personal Data
    1. You consent to the collection, use, disclosure of your Personal Data by TCAM for the purpose of the Trial. For the detail of Personal Data Protection Policy, please refer to our web at http://tcam.com.sg/pdp-2/.
  1. Renewals and other similar packages
    1. Upon expiry of the Services and for a period three (3) months thereafter, you consent to be contacted by StarHub regarding similar services at retail or promotional rates.
  1. Force Majeure
    1. StarHub, TCAM and Silverline will not be liable for any delay or failure in performance under the Trial resulting from matters beyond our reasonable control. These include acts of God, requirements of any governmental or regulatory authority, war, national emergency, accident, fire, lightning, equipment failure, computer software malfunction, electrical power failure, faults, interruption or disruption of the networks of StarHub, the devices provided for the Trial, your equipment or the equipment of any third party, riots, strikes, lock-outs, industrial disputes (whether or not involving our employees) or epidemics of infectious diseases.
  1. Applicable Laws and Jurisdiction
    1. The laws of Singapore will govern the Trial and you agree to submit to the jurisdiction of the Singapore courts.
  1. Others
    1. StarHub reserves the right to amend these Trial Terms and Conditions at any time and without notice. Our publication of the revised Trial Terms and Conditions, and your continued participation in the Trial shall be deemed as acceptance of the amendments.
